    One of my friends is in law school right now and in the main topics these lawyers are sudying is the lawncare/landscaping industry and thier contract and liabilities. The professors told the sudents that is was important due to this being a fast growing industry here in NC.

    They not ony were covering the contracts but workmans comp, owners liabilities for employees and customers.

    He was able to verify what I had researched on workmans comp. I'm not sure if it state or federal but here in NC you do not need workmans comp until you hire your 4th employee. Owners do not need workmans comp and can opt not to have it. He also said that when you hire 12 or more employees workmans comp is handled a little different.

    The entire reason worker compensation exists is so the courts do not get clogged with workers filing actions against their employers.

    In a civilized state north of the Mason and Dixon line like the Commonwealth of Pennsylvania ALL employees must be covered under a workman’s comp policy. It is about 10% of total payroll for lawn scraping.

    What happens is when the employee is covered under workman’s comp he gives up the right to sue his employer in most cases.

    One of the pitfalls you want to avoid as an employer is to use contract labor from an employment agency. When a contract employee gets hurt working indirectly for you he can and will sue YOU for you are not holding the workman’s comp policy.

    The land sharks are on the loose. You better have your ducks in a row or you can say goodbye to all of your net worth.
