  • I need samples of.....

    Hey all,
    I'm trying to figure out how you ensure payment from customers. I had only couple of customers who didn't pay last year, and made sure that they will no longer be customers. I want to prevent this from happening in the future, and therefore I'm looking for a one-time type of contract. I tried making one up on excel, but I'm brain dead from all this studying for finals week. If anyone can send me a copy of what they usually have customers sign for a one time thing like mulch I would appreciate it.

          Service Agreement

          This Contract for Services (“Contract”) is made effective as of_________________ by and

          between___________________________________________ ___________________________ (hereinafter the “Customer”) and Campbell Landscape Services, P.O. Box 1562 Homewood IL, 60430 (hereinafter “CLS”)

          1. DESCRIPTION OF SERVICES. Beginning on _______________, and continuing until ________________CLS will provide to the Customer the services itemized in the attached Schedule A (collectively, the “Services”).

          2. PAYMENT FOR SERVICES. In exchange for the Services, Customer will pay CLS according to one of the following schedules (check one of the below):

          ( ) Eight equal payments of: ___________________ (March thru October) on the _______ day of each month. Payment is due in advance for the Services to be performed in the 30 day period following the date of payment.

          ( ) Weekly payments of: ______________to be made on the day those Services are provided.

          The payment amounts specified in this paragraph apply only to the Services in Schedule A. Any additional Services requested by the Customer will be performed on an “as requested” basis, for an additional fee as agreed between CLS and the Customer at that time (“Additional Services”). All requests for Additional Services, and the agreed price for such Additional Services, shall be documented by an addendum to this Contract, dated and initialed by both the Customer and CLS.

          All amounts due and owing under this contract shall accrue an additional one and one half percent
          (1.5%) per month interest for any amount past due over thirty (30) days, and shall continue to accrue such interest until paid in full. Such amount will be added to the monthly/weekly/as requested payment amounts specified above. If any amount due according to this contract has to be collected by or through an attorney or collection agency, Customer agrees to pay all fees and expenses, including all attorney fees and costs, related to the collection of the amount owed.

          3. TERM. This contract will be binding on the parties only for Services to be performed, and to be paid for, during the calendar year specified in paragraph 1. During the calendar year specified in paragraph 1, Customer may notify CLS of their intent to terminate this contract, but such termination shall not become effective until 30 days after receipt of such notice by CLS, and Customer shall remain liable to pay CLS for all Services scheduled to be performed during that 30 day period. This contract shall not terminate until CLS has received all amounts due from Customer.

          4. WARRANTIES. CLS shall provide its services and meet its obligations under this Contract in a timely and professional manner. CLS warrants that its services will meet an objective standard of care equal to, if not superior to, the standard of care customary in the professional lawn care and/or landscaping industry.


          5. DEFAULT & CANCELLATION. In addition to any and all other rights either party may have by law, if a party defaults by failing to substantially perform any provision, term, or condition of this Contract, including without limitation the failure to make a monetary payment when due, the other party may terminate the Contract by providing written notice to the defaulting party. This notice must describe in detail the nature of the default(s). The party receiving such notice shall have 30 days from the effective date of such notice to cure the default(s). Unless waived by a party providing notice, the failure to cure the default(s) within such time period shall result in the automatic termination of this Contract. If this Contract is terminated, the account balance, plus any interest, expenses, attorney fees and costs, is due and payable immediately.

          6. ENTIRE AGREEMENT. This Contract, including all schedules and addendums thereto, contains the entire agreement of the parties. Verbal agreements, representation and/or warranties, whether expressed or implied, are not enforceable. All enforceable agreements must be in written form, dated and initialed by both parties. This Contract supersedes any prior written or verbal agreements between the parties. There are no other agreements or warranties made by Campbell Landscape Services, whether expressed or implied, other than specifically stated in this Contract.

          7. SEVERABILITY. If any provision of this Contract should be held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable.

          8. AMENDMENT. This Contract may be modified or amended, but only by a written addendum that is dated and signed by both parties.

          9. GOVERNING LAW. This Contract shall be construed in accordance with the Laws of the State of Illinois.

          10. NOTICE. Any notice required or permitted under this Contract shall be sufficiently given if delivered in person or by certified U.S. Mail, return receipt requested, to the addresses set forth below.

          11. ASSIGNMENT. Neither party may assign or transfer this Contract without prior written consent of the non-assigning party, which approval shall not be unreasonably withheld.

Campbell Landscape Services shall service the lawn of the Owner approximately 28 times during the lawn service year depending on weather and growing conditions.

          ( ) Flower bed leaf clean-up and weeding.

          ( ) Complete fall leaf clean-up.

          ( ) Storm clean-up.

          ( ) Shrubs trimmed ___ once / ___ monthly

            2 cents!

            Learn the in's and out's of small claims courts.
            Also include a court cost recovery clause in your contacts.
            Get a cheap digital camera (under 30.00) and document every job, yes it is tedious but it will provide support if it goes to court.
            Make damn sure your late fee/interest rate is legally acceptable in your state and learn how to figure it out. Judges do not like doing your math for you, and going over the legal limit is usery and will nulify the contract.

              This is an interesting Contract. I'm new to the site and still haven't found an example of a Landscape Contract. Any help or direction would sure be appreciated.
