You could say the sod provides instant thick turf which will have a less likely chance to be invaded with weeds down the road. Whereas with seed it will take time to establish the sod quality turf and you risk the chance for weeds to emerge.
If they demand a guarantee I would definetly state, in writing, that they are the ones responsible to provide the neccessary care to the sod/seed for the 90day period. If the neccessary care is NOT provided (such as adequite water, fertilizer) you will not be held responsible for the sod/grass.
I used to guarantee all the seeding jobs I did. I would tell my customer that the seed was guaranteed to grow, but once I saw that the seeded area was dry (not watered correctly) then the guarrantee was void. Of coarse most my customers assumed you only needed to give the seed that intitial "miracle watering" and that was it. I never did have to replace any seed dispite my repeated customers screw-ups.
There was an article in some trade publication about 2 months back about this issue of whether to warranty seeding jobs. They mainly addressed the issue of warranting hydro-seeding jobs. Essentually the larger companies interviewed would warranty the job, but only as a sales tool to sell more hydro-seeding jobs.
Whatever you do, make sure whoever is responsible to care for the turf that they understand the importance of suppling enough water!
