    clclawn is correct. the professional and more importantly correct way to deal with accidents like that is to either pay out of pocket or file it on your ins. thats why you have ins. after all.

    why should this home owner file a claim on his insurance because you broke a window?

    safari makes a great point as well and IMO is correct as well.

    the time i tore up a piece of siding on a clients house i asked how they wanted to handle it. they decided to do the calling around to get the piece ordered but i would have been than willing to do that myself.

    you should either discuss how the client wants to handle the situation or handle it yourself. make it as easy for the client as possible.

      There is no doubt that I threw the rocK thru the window and i really do not have a problem paying. This particular place is going to be so hard to mow ( I will have to mow perpendicular to the house on all four sides, which I did the last time and it took even longer.

        I owe a customer $360 for damage to the corner of his house because an employee ran into it with a wb mower and never said boo about it to his crew mates or to me until I had to ask about what the heck was going on and document the damage. I told the care taker to fix it and send me the bill.

        Raising his rate mid season to "cover" the bill would be ridiculos. The customer would see that for what it is and wonder who was getting scammed. Suck it up; its the cost of doing business.
        I,m not worried about sucking it up. Its the inherritent danger of busting something else.

          Even If I told him I would no longer be responsible for damages and even if we had a contract which we do not it will not release me from any damage liability.

              There is no question of liability here. I broke the window. I am responsible. I will pay for it no questions asked. I'm worried about the future of mowing this lawn. I have meeting with my attorney on another matter and I'm gonna get his take on this. In the absense of a written contract I'm not sure I want to cut this with out a damage waiver, so if am not to raise his rate I will need some assurance that I'm not losing my butt on this job.                 Steve: Great to hear from you. I been hitting the busch light hard this week worring about how to handle this. Raise his rate at the beginning of next season sounds like the best option. Thanks.

                  It has been my experience that these kinds of accidents come in 3s. I can go 3 years or more and not break anything, but then something happens and I'm just waiting for the rest of the sheet to hit the fan!

                    If you arent making any money on this cut why would you want to continue this season?

                    The window is 1 issue the pay is another..... handle your business and quit being affraid. He wasnt affraid to adjust your bill was he?

                    "well im gonna just keep taking a hit all year on this one because i broke his window and now Im affraid to confront him on the pay". YA I DONT THINK SO!

                    Personally I wouldnt say another word about the window except for documents ,,, and honestly that note he gave you will suffice. Just claim it as a loss. That wont get you audited. Arguing w/ this guy about 200 bux and the way he went about it is going to go nowhere,,, its done now you know next time this happens to explain the process YOU require so your bill dont "get adjusted". Lesson learned quit loosing sleep over it.

                    Just a suggestion- Next time you break a window take control of the situation. "I broke your window here's how it works. I have a company coming out this evening to look at it I ALREADY CALLED THEM I'll get up to 3 estimates (if you want) you pick the provider since its your house"

                    Issue # 2 your pay.... ya your gonna to grow some man. If it comes up it has nothing to do w/ the window dont even entertain that theory with him if he goes there. Stand up for yourself its his problem if he dont like it not yours.

                        where did i say anything about releasing you from damage liability???

                        i'm saying you broke you the window you should either pay out of pocket for it or file a claim with YOUR insurance.

                        i read a post about you referring to the home owner filing a claim on there insurance which is totally WRONG.

                            I mowed it today and he was there. I put the mulch plate on and it looked like s. He never came out to talk or anything. If it was mine I would at least pick up some of the rocks around there. The critter dug up at least half dozen more places. I'm not afraid to mow it's just a waste of my time. His wife even came out and apoligized for him being an a. Sporty I didn't aim that at you. As long as I work there Im Liable. When I was twelve years old I mowed ten lawns in my neighborhood, I caddyed three days a week at the country club, and I sold fishing tackle I recovered skin diving near where I lived. I never had insurance. The first year I cut professionaly I didn't have any. Today you would be crazy to drive a mower off the trailer any where without any. I guess that it's just getting harder to accept the fact that things have changed that much. Free enterprise is one of the basic foundationdations of our country. A Kid with a lawn mower has just as much right to make money pushing it down the street as anybody else, except today he better have ins. SAD.
