  • who's gonna be in trouble, the applicator or the company?

    i was messing with a boy the other day who was putting down pre-em on a yard. he was using the same product as i use which the label states, long sleeve shirt and pants, plus chemical resistant gloves. he also had two unlabeled back-pack sprayers in his truck for spot treatment of weeds. (va. law requires them to be labeled just like the big tanks) the boy had no gloves and short sleeves. when i joked with him about being caught, he said the company does not require him to wear the proper stuff cause it was too hot and they don't worry about small things like back-pack sprayers. he also said it is the company's azz, not his............................

    Both the company and his azz will be in trouble.

    Interesting you mention this Steve-O. I too spotted a little sport out applying lawn pesticide for his employer just the other day wearing long pants and a short sleeve shirt..........oh, but he had gloves, so he's safe.

      In WA, the applicator will get some state supplied education and told to "go and sin no more". The company would be fined and told to "go and sin no more, or else..."

        I dun re-thought this and gots me a question... What happens when the applicators ballz turn green in 8 years?

          then they start checking out everything. permit, business permit, insurance, records for the last two years, anything and everything.

            He can sue the company he worked for.

            The original question reminds me of when I worked for a local dairyman, I was a milker and shared his Herdsman responsibilities. The dairyman sent me and another guy out into the cornfield to spray some weeds. He gave us backpack sprayers, a measuring cup and the gallon of chemical. He told us that we would use half of it over the 3 acres. Np ppe was issued and no calculator to figure out the dosage.

            Well, we sprayed out the gallon and got only half the cornfield done. I forget how long we were out there, but I do remember that my boss came unglued that we used all of this very expensive gallon of product and only got half the field done! That was the last time he sent us out to spot spray.

              today in hooterville........

              this was BRICKMANS. they do the common areas in this hood i'm in. today the guy had on a short sleve shirt, no gloves period, with an un-labeled back-pack. i don't even know what he was spraying cause even the weeds are stressed around here cause of no rain in 6 weeks or so. the next was a small outfit like me. the guy had two mexicans with un-labeled back-packs spraying mulch beds while he sat in the truck. i give them credit though, they had long sleve shirts on, but no gloves and i can't imagine them having permits whether it be tech or a full license.
