  • Dispute With Customer Over Cleanup

    Hey LCO's,

    I had a problem with a customer over a cleanup job. The original job is S.Cleanup + Mulching. Very minimal cleanup, no hedgework, no raking, just minimal weeding of the beds and mowing/edging/trimming the lawn, plus laying 4 yards of mulch. Bid the job at $350. I miscalculated the area of the mulch by a lot (partly cuz workers laid it on way too thick some places). Told the customer extra mulch would be extra money, probably $160-170 range. They drive a Porsche and wife has called over 6 times this week, wants it done ASAP, so with no time to have a delivery made, I buy bags at $40/yd from Home Depot (dropped delivery fee b/c I made original miscalc), and Charge 70/yd to buy and lay it, ends up being 215, 565 total for the job. Guy flips out on me on the phone yesterday, I tell him I fix the job to his satisfaction. My worry is that the wife said she wanted only basic cleanup done, not heavy duty, but the husband is pointing out all this extra stuff I "missed" that was never agreed upon (removing about 20 branches and pile of compost from side of house, cleaning up extra leaves around shed). Problem is, I'm not a registered biz yet(have been talking to an accountant who will set us up by May) and I want to get paid. Would you guys perform the extra work at no charge, or charge it? Any help appreciated. Thanks.

      Tell the Husband exactly what you agreed apon... And go from there.

      You need a brief detailed description on what you were going to do & what you were going to charge & had Mrs. Porsche sign it... Then you might not have these problems...

      There is more broke down & out poor people driving high dollar vehicles than you could imagine. I drive past many houses way under a $100K with over a $100K vehicles in their yards. Of course most of them can afford them they just don't know how to invest money but who cares...

      I'm really scared of folks that have high dollar vehicles that live in $350K plus homes...

      I've been in several homes $300K plus that people been living in for a year or longer with Bean Bags for chairs or folding lawn chairs in den with Portable TV on Milk Crate or box, Plantation shutters on front & sheets over rest of the windows.

      I was in one Nice 4,000 or so sq.ft. House probably $400K or more, nothing but Picnic Table on ground floor, all exposed sub flooring, sheets over windows & nothing up stairs but bedroom suite & portable TV. They had been living there 3 years.

      LOL, I was there demoing a 27" Tru Cut Reel Mower for $1795 & when wife found out price she gave me grand tour of the Keeping up with the Jones's Taj Mahal? She told the husband to stay outside? I would have gave her the mower if she wanted it?

      I don't think she cooked they both skinny, Oven looked like it still had the owners manual in it & they had 2 Microwaves. I had to load the Mower by myself, they were arguing real good. I could tell the wife was the boss maybe Biff's dad will leave him a lot because he's gonna need it, if I ever decide to get me a life & leave my wife, 2 daughters, 2 Kats & Roscoe I might think about seeing if they ever got a reel mower...

      Until then I will slave away on this Puter clicking on Delete, Edit, Ban & Move Thread. While not doing that I will have a Paint Brush in one hand & a Honey Do list in the other hand. In 5 years I've painted 1 bathroom 3 times fixing to be 4th. I dislike all shades of Purple, Khaki, Mauve & Off White with all my heart.

      I can't even drive by Sherman Williams, Porter Paints, Lowe's or Home Depot without my chest hurting me real bad...

      Sorry I can't write more, I'm gonna go load that Reel Mower (YEEEEHA) if I can get this paint brush off my hand?

        I agree, do the job at the agreed upon price and chalk it up a learning experience.

        Now I'm not sure how it is in your state, but I'm fairly certain its like here in WA. Since you are an unlicensed biz, you have no legal grounds to sue or lein for your money; and since you are unlicensed, you left the door wide open for your customer to screw you out of some or all of your money.

        In WA, the guy could legally hire you to do the work, and then just refuse to pay you, just because he can. Its not ethical, but legal in WA. Thats why some guys have tried to screw me over in the same way, and lost in Small Claims Court when I sued BECAUSE I am legal.

        Get licensed yesterday.

            I feel your pain on the painting GM. We've only been in our new house less then 6 months and I have painted the kitchen 3 times. I told the wife today I was going to call someone to do the rest of the painting! How I hate painting!!

                The extra work you did was minimal. You did it without asking for more money because you knew it was no big deal. I'm sure that if your mulch amount had worked out, you wouldn't have even brought up the small amount of extra work....right?

                So to bring up the extra work NOW just to make the mulch difference justified isn't the best thing to do.


                Just do it for what you bid and move on to the next one. You'll do better on the next one.
